Let’s get one thing clear. You do not have a legal relationship with your stepchildren. Even though you are married to their father, you have no legal rights to those kids. In the eyes of the law, you’re not related in any way.
In some states, as I’ll discuss later on, even though you have no legal rights, you are obligated to pay for the children living in your house, but as you’ll see, your lack of legal standing regarding the kids has some pretty big implications.
For instance, you are not allowed access to school records, and if your stepchild has to be rushed to the hospital, you can’t give the doctors the okay to give your stepchild the care he needs. You also can’t bring your stepchild to get her first driver’s license because your signature isn’t valid. It’s a good idea to have your husband and his ex sign a legal guardianship document so that you can at least pick a stepchild up from school and take him to the hospital if there is an accident.
